Правозащитные организации видят в ЧВК лишь изощренную форму классического наемничества. Тем не менее разница существенна. Если суммировать, то согласно статье № 47 Женевской конвенции, наемник — это иностранец, который временно завербовался по личной инициативе для непосредственного участия в вооруженном конфликте с целью получения личной выгоды. На наемника не распространяется статус военнопленного. Конвенция ООН относит к категории наемников также тех, кто завербован для участия в актах насилия, направленных на свержение правительства какого-либо государства, подрыв его конституционного порядка или нарушение его территориальной целостности.
Между тем, к сотрудникам частных военных компаний эти размытые определения трудно применимы. Сотрудники ЧВК работают по контрактам в качестве советников и технических специалистов, а не прямых комбатантов (по крайней мере, так декларируется). Формально в вопросе мотивации трудно провести грань, например, между наемниками, иностранными добровольцами и инструкторами ЧВК, ведь все они получают материальное вознаграждение. Разница лишь в его размерах.
Попытки выработать единые стандарты для системы контроля за деятельностью ЧВК тоже пока не увенчались успехом. Особенно в преодолении непрозрачности и недоступности этих структур в финансовых вопросах. Существует на уровне дискуссии, по крайней мере, две концепции. Первая — создание «частного клуба» со штаб-квартирой в Женеве, куда войдут представители ведущих компаний частной военной и охранной индустрии. Они, как планируется, и будут осуществлять контроль за следованием «военными частниками» стандартам ООН, если таковые все-таки будут выработаны. Второй вариант еще проще — частные военные и охранные компании должны находиться под контролем государственных структур. Однако, как показал опыт, госструктуры интересует контроль над ЧВК только в плане соблюдения собственных интересов, а они, как известно, у каждого государства свои.
